Terms of Service
1. Agreement to these terms
These Terms of Service (“Terms”) form a binding agreement between you and WiseSam (“we”, “our”, “us”) and govern your access to and use of the WiseSam platform, including the web dashboard, the AI assistant service, and any associated channels (collectively, the “Service”).
By creating an account, completing checkout, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Service.
2. The service we provide
WiseSam provides a personal AI assistant that you interact with via a web dashboard and supported messaging channels. The assistant can help draft messages, recall information you share with it, manage its own dedicated email address on your behalf, and connect to optional third-party services that you choose to authorise.
The Service is offered “as is” and we are continuously improving it. We may add, change, or remove features at any time. We will give reasonable notice of material changes that affect how you use the Service.
3. Your account
- You must be at least 16 years old to use the Service.
- You are responsible for keeping your password and access credentials confidential.
- You may not share your account or allow another person to use it without our written permission.
- You agree to provide accurate, current information when signing up and to keep it up to date.
- You are responsible for all activity that occurs under your account.
4. Acceptable use
You agree not to use the Service to:
- Generate, store, or distribute illegal, harmful, fraudulent, defamatory, or abusive content
- Produce content that depicts the sexual exploitation of minors, or any other content prohibited by applicable law
- Impersonate another person or entity, or misrepresent your affiliation with one
- Send spam, unsolicited bulk communications, or phishing messages of any kind
- Probe, scan, scrape, or test the vulnerability of any part of the Service without our prior written consent
- Reverse-engineer, decompile, or attempt to derive the underlying source code of the Service, except to the extent expressly permitted by law
- Use the Service to develop a competing product, or to train another machine-learning model on our outputs
- Violate the rights (including privacy and intellectual property rights) of any third party
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these rules or pose a risk to the Service or other users.
5. AI outputs — limitations and responsibility
The Service uses large language models and related AI systems to generate responses. AI output can be inaccurate, incomplete, or inappropriate. You should not rely on the Service for advice that requires professional judgement — including but not limited to legal, medical, financial, or safety-critical decisions.
You are responsible for reviewing AI output before acting on it, forwarding it, or sharing it. The Service is a tool to assist you, not a replacement for your own judgement.
6. Your content
You retain ownership of all content you provide to the Service (“Your Content”), including messages, files, and any material you ask the assistant to act on. You grant us a limited, non-exclusive licence to process Your Content solely to operate the Service for you — for example, to generate responses, store your conversation history, or relay messages to authorised third-party services.
We do not use Your Content to train AI models — ours or anyone else’s — and we do not sell or share it with advertisers. See our Privacy Policy for full details.
7. Subscriptions, billing, and cancellation
Access to the Service is provided on a paid subscription basis. Pricing, billing cadence, and any introductory offers are shown at checkout and confirmed by email when you subscribe. Payments are processed by Stripe.
Unless stated otherwise, subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time from your account dashboard; cancellation takes effect at the end of the current billing period and you keep access until then.
Except where required by applicable law, we do not provide refunds for partial billing periods or unused time.
We may change prices for future billing periods. We will notify you at least 30 days before any price change affects your subscription.
8. Third-party integrations
The Service can connect to third-party services (for example, Google Calendar) that you choose to authorise. Those services are operated by their respective providers and are subject to their own terms and privacy policies. We are not responsible for the availability, accuracy, or behaviour of any third-party service. You can revoke access at any time from your account settings or from the third-party provider’s own dashboard.
9. Service availability
We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure failures, or outages at our sub-processors (such as Stripe, Firebase, or AI providers) may cause temporary unavailability. We are not liable for losses resulting from downtime.
10. Intellectual property
The WiseSam name, branding, dashboard, and underlying software are our intellectual property or used under licence. Except for the limited rights expressly granted in these Terms, no licence is granted to you in respect of any of our intellectual property.
11. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate or fit for a particular purpose.
12. Limitation of liability
To the maximum extent permitted by applicable law, neither WiseSam nor any of its directors, employees, or contractors will be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising from your use of the Service.
Our total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the amount you paid us in the three months preceding the event giving rise to the claim, or (b) one hundred US dollars (US$100).
13. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss, or liability (including reasonable legal fees) arising from (a) Your Content, (b) your use of the Service in breach of these Terms, or (c) your violation of any law or third-party right.
14. Termination
You can stop using the Service at any time by cancelling your subscription and deleting your account from the dashboard. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your right to use the Service ends immediately; sections that by their nature should survive (including ownership, disclaimers, and limitations of liability) will continue to apply.
15. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or via an in-product notice. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of France, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer-protection laws of your country of residence provide otherwise.
